Terms of Service

The Site is operated jointly by two affiliated legal entities: CREDMINDS (SMC-PRIVATE) LTD. (registered in the Islamic Republic of Pakistan; registered office: Credminds, 2nd Floor, 902B, Faisal Town, Lahore, Pakistan) and CREDMINDS TECHNOLOGIES (registered in the United Arab Emirates). Throughout these Terms, “Credminds”, “we”, “us”, or “our” refers to the entity with which you have a contractual relationship (or, in the absence of one, to both entities jointly to the extent applicable).

These Terms govern visitor use of the Site only. Any paid services, engagements, or deliverables provided by Credminds are governed by a separate signed Services Agreement, Master Services Agreement, or Statement of Work between you and the relevant Credminds entity. In the event of any conflict between these Terms and a signed agreement, the signed agreement prevails with respect to the subject matter it covers.

By accessing or using the Site, you represent that you have read, understood, and agree to be bound by these Terms, the Privacy Policy, and the Cookie Policy, each as may be updated from time to time. If you are accessing the Site on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

• Site means credminds.com and any subdomains.
• Services means any consulting, engineering, advisory, or other professional services provided by Credminds under a separate signed agreement.
• Content means all text, graphics, images, logos, designs, code, data, and other materials made available on or through the Site.
• User or “you” means any natural or legal person who accesses or uses the Site.

Subject to these Terms, you may:

• Browse the Site for the purpose of evaluating Credminds and our offerings;
• Read, view, and download Content for personal or internal business reference;
• Submit enquiries through the contact form on the Site;
• Navigate to third-party services linked from the Site (including the Careers portal operated by Hirestream).

You agree that you will not, and will not permit any third party to:

• Scrape, crawl, harvest, or otherwise systematically extract Content from the Site at scale or by automated means, except where expressly permitted by Credminds in writing or by a published robots.txt directive;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of any software underlying the Site, except as permitted by applicable law that cannot be contractually waived;
• Probe, scan, test, or attempt to exploit vulnerabilities of the Site or its infrastructure, except in accordance with the vulnerability-disclosure process described on our Security page;
• Submit automated, bulk, fraudulent, or misleading enquiries through the contact form;
• Impersonate any person or misrepresent your affiliation with any person or entity;
• Transmit any virus, worm, trojan, or other malicious code through any input on the Site;
• Use the Site in a manner that infringes the intellectual-property rights, privacy rights, or other rights of Credminds or any third party;
• Use the Site for any unlawful purpose or in violation of any applicable law, regulation, sanctions regime, or court order.

All rights, title, and interest in and to the Site and the Content (including all copyrights, trade marks, designs, trade secrets, and other intellectual-property rights) are owned by Credminds or its licensors, and are protected by applicable law. Except for the limited rights expressly granted in Section 4, no licence or other right is granted to you under these Terms, by implication, estoppel, or otherwise.

The names “Credminds”, “CREDMINDS”, the Credminds logo, and any related marks are trade marks of Credminds. You may not use them without our prior written consent.

When you submit information through the contact form or any other input on the Site (a “Submission”), you represent and warrant that:

• The Submission is accurate to the best of your knowledge;
• You have the authority to submit the information, including any information about an organisation you represent;
• The Submission does not infringe the intellectual-property rights, privacy rights, or confidentiality obligations of any third party.

You grant Credminds a non-exclusive, worldwide, royalty-free licence to receive, store, and Process the Submission solely for the purpose of responding to your enquiry and (where applicable) entering into and performing a Services engagement with you. The handling of Personal Data in Submissions is described in the Privacy Policy.

The Site may contain links to third-party websites or services that are not owned or controlled by Credminds, including (without limitation) the careers portal operated by Hirestream and content delivered through Google Fonts. Credminds is not responsible for, and does not endorse, the content, privacy practices, or operation of any third-party site or service. Your use of any third-party site or service is at your own risk and is subject to that third party's own terms.

To the maximum extent permitted by applicable law, the Site and the Content are provided on an “as is” and “as available” basis, without warranty of any kind, whether express, implied, or statutory. Without limiting the foregoing, Credminds disclaims all warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, availability, security, and freedom from error or interruption.

Credminds does not warrant that the Site will operate uninterrupted, that defects will be corrected, or that the Site is free of viruses or other harmful components.

To the maximum extent permitted by applicable law, in no event shall Credminds, its affiliates, or its respective directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with your access to or use of the Site, including without limitation loss of profits, loss of data, loss of goodwill, business interruption, or substitute services, even if Credminds has been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, the aggregate liability of Credminds arising out of or in connection with your access to or use of the Site shall not exceed one hundred United States dollars (USD 100). This limitation reflects the fact that the Site is provided to visitors free of charge. The limitation does not apply to liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Credminds and its affiliates and their respective directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any applicable law or the rights of any third party; or (c) any content or information you submit through the Site.

Our collection and use of Personal Data through the Site is described in our Privacy Policy and our Cookie Policy. Both documents are incorporated into these Terms by reference.

Credminds may revise these Terms from time to time to reflect changes in our practices, applicable law, or the operation of the Site. The “Effective” and “Last updated” dates at the top of these Terms indicate when they were most recently revised. Material changes will be notified by reasonable means (for example, by posting a prominent notice on the Site). Your continued use of the Site after the effective date of any change constitutes your acceptance of the revised Terms.

Credminds may, in its sole discretion and without notice or liability, restrict, suspend, or terminate your access to all or any part of the Site at any time, including (without limitation) where Credminds reasonably believes that you are in breach of these Terms or applicable law, or that your use of the Site poses a security or operational risk.

15.1 Engagements with CREDMINDS TECHNOLOGIES

If you have entered into a contract with CREDMINDS TECHNOLOGIES, these Terms (together with that contract, in respect of any conflict for which the contract is silent) shall be governed by and construed in accordance with the laws of the United Arab Emirates, and the parties submit to the exclusive jurisdiction of the courts of Dubai, UAE.

15.2 Engagements with CREDMINDS (SMC-PRIVATE) LTD.

If you have entered into a contract with CREDMINDS (SMC-PRIVATE) LTD., these Terms (together with that contract, in respect of any conflict for which the contract is silent) shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, and the parties submit to the exclusive jurisdiction of the courts of Lahore, Pakistan.

15.3 Visitors with No Contractual Relationship

For visitors who have not entered into a contract with either entity, these Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, and the parties submit to the exclusive jurisdiction of the courts of Dubai, UAE, as the default operating jurisdiction of the Site. This Section 15.3 does not deprive you of any protection afforded to you by mandatory provisions of the law of the country in which you are habitually resident.

If any provision of these Terms is held to be invalid, illegal, or unenforceable in any jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not be affected, and the invalid provision shall be construed (or severed) to give effect to the parties' original intent to the maximum extent permitted by applicable law.

These Terms, together with the Privacy Policy, the Cookie Policy, and any other policy or notice referenced on the Site, constitute the entire agreement between you and Credminds with respect to your use of the Site, and supersede all prior or contemporaneous understandings on that subject. Where you have entered into a separate signed Services Agreement with Credminds, that agreement governs the subject matter it covers.
